Please read these Terms and Conditions (“Terms”) carefully before using the FYIList website (https://fyilist.in) or any related services. By accessing or using FYIList, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or Services.

1. DEFINITIONS

• “FYIList,” “we,” “us,” or “our” – refers to FYIList.in, the owner and operator of the website and related services.
• “You” or “User” – means any individual or entity accessing or using the FYIList site or Services.
• “Services” – refers to the online platform provided by FYIList (the website, app, and related features) that enables users to share, discover, and aggregate products. FYIList does not sell products directly; it provides community-curated links that redirect to third-party retailers (often using affiliate links).
• “User Content” – means any text, images, reviews, ratings, comments, links, listings, or other materials that users submit, post, or share on the Site (including product suggestions, comments, and reviews).
• “Third-Party Content” – means any content, products, services, or materials not created by FYIList, including content hosted on or linked from external websites and retailers. This includes products, prices, or information displayed via embedded links, advertisements, or banners on FYIList.
• “Intellectual Property” – refers to all forms of proprietary rights and interests including copyrights, trademarks, service marks, trade dress, patents, trade secrets, and other intellectual property rights. FYIList owns or licenses the Site’s original content and branding. (Product images, logos, and descriptions of third-party products may be the property of the respective third-party rights holders.)
• “Account” – means an individual user account registered on FYIList. An Account is required to post or curate content on the platform.
• “Privacy Policy” – refers to FYIList’s data collection and privacy practices (available on the Site). By using FYIList, you also agree to the terms of our Privacy Policy.

2. INTRODUCTION AND ACCEPTANCE:

These Terms constitute a binding agreement between you and FYIList regarding your access to and use of the Site and Services. By accessing or using FYIList (including any mobile app), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to amend these Terms at any time by posting a revised version on the Site (see Modification of Terms below for details). Your continued use of FYIList after any changes are posted signifies your acceptance of the new Terms. If you do not agree to any updated Terms, you must stop using the Site and Services.

3. DESCRIPTION OF SERVICES: 

• FYIList is a product aggregator and redirect platform. We provide a searchable catalog of products with user-curated listings and reviews, and we offer links to third-party retailers where those products can be purchased. FYIList does not sell products directly, and we do not process any payments or orders on our site. All product purchases and transactions are completed on third-party retailer websites.
• FYIList may earn affiliate commissions from certain links; however, we have no direct control over the products, services, or transactions on external sites. When you click a product link or “Buy” button on FYIList, you will be redirected to a third-party retailer’s website (for example, an e-commerce site) to complete your purchase. As such, FYIList holds no responsibility or liability for the availability, quality, pricing, warranties, shipping, returns, or any other aspects of products and services offered by third-party retailers. Users must refer to the retailer’s own terms, conditions, and policies (such as payment terms, shipping, return, refund, and warranty policies) for any issues related to a purchase. (This disclaimer applies equally to any third-party advertisements or promotions accessible through FYIList.)
• FYIList provides the Services on an “AS IS” and “AS AVAILABLE” basis, without any warranty of any kind. While we strive to maintain a useful and reliable service, we do not guarantee that the Site will be uninterrupted, secure, or error-free, or that it will be free of viruses or other harmful components. We also do not warrant the accuracy or completeness of any product information, prices, or other content displayed on FYIList. Users assume all risk associated with their use of the Site and reliance on any information or content provided through the Service.

4. ELIGIBILITY AND ACCOUNT REGISTRATION:

• Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By creating an account or otherwise using FYIList, you represent and warrant that you are at least 18 (or such age of majority). Users under 18 are not permitted to register or use the Service unless they are under the supervision of a parent or legal guardian who consents to and agrees to be bound by these Terms on the minor’s behalf. If you are a parent or guardian of a minor who uses FYIList, you are fully responsible for that minor’s use of the Site, including all legal liability that he or she may incur. 
• Registration Data: When registering for an Account, you agree to provide true, accurate, current, and complete information as requested (for example, a valid email address and a secure password). You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your Account. 
• Account Security: You must not share your login information or account access with others. You agree to promptly notify FYIList of any unauthorized use of your account or any other breach of security. FYIList may, at its discretion, require you to verify your email address or use other authentication methods to confirm account ownership and ensure the security of your Account. FYIList will not be liable for any loss or damage arising from your failure to safeguard your account credentials. 
• Account Termination: FYIList reserves the right to suspend or terminate your Account at any time, with or without notice, for any reason, including but not limited to suspected misuse of the platform or violation of these Terms. Upon termination of your Account, your right to use the Services will cease immediately. You may also choose to delete your Account at any time. If your Account is deleted or terminated, you must stop using the FYIList Site and Services, and note that certain user content you provided may no longer be accessible (subject to our data retention policies).

5. COMMUNITY GUIDELINES AND USER CONTENT:

FYIList is built on user contributions and a respectful community of shoppers and enthusiasts. When posting or submitting any content to the Site (including product listings, links, reviews, comments, or other material), you agree to abide by the following rules:

• Lawful Conduct: You will not post any User Content that violates any local, state, national, or international law. This includes (but is not limited to) content that is defamatory, obscene, pornographic, vulgar, indecent, lewd, harassing, hateful, racially or ethnically offensive, abusive, threatening, or otherwise unlawful. You also agree not to post any content that infringes anyone’s intellectual property or other rights (including copyright, trademark, trade secret, privacy, or publicity rights). Additionally, you must not upload or share content that contains viruses, malware, or any harmful code, and you must not distribute spam, unsolicited advertising or bulk electronic communications, chain letters, or engage in phishing or fraudulent schemes on the Site.
• Accurate Representation: You must not impersonate any person or entity, or misrepresent your identity or the origin of any content you post. Only submit content that you have the legal right to share. By posting any User Content, you represent and warrant that you are the creator or rightful owner of that content, or that you have obtained all necessary rights, licenses, and permissions to upload and share the content on FYIList.
• Relevance and Community Standards: FYIList is a product-focused platform, and User Content should be relevant to products, shopping, or related discussions. You agree not to post content that is off-topic or unrelated to the platform’s purpose. You also must not engage in personal attacks, bullying, or harassment of other users. Any form of hate speech, bigotry, or discrimination (e.g., on the basis of race, religion, gender, sexual orientation, etc.) is strictly prohibited. Do not post any content that is excessively violent, graphic, or otherwise inappropriate for a general audience.
• No Explicit or Illegal Content: You may not post pornography or sexually explicit material on FYIList, and you must not use the Service to disseminate illegal content of any kind (such as content involving exploitation of minors, instructions for illegal activities, etc.). Such content is strictly forbidden and will be removed if encountered, and may result in account termination and reporting to authorities where appropriate.
• Moderation and Removal: FYIList reserves the right (but has no obligation) to monitor and moderate User Content. We may edit, refuse to post, or remove any User Content at our sole discretion, for any reason, including if we believe it violates these Terms or our community guidelines, or for no reason. Users who repeatedly violate the rules or post prohibited content may have their accounts suspended or terminated without notice. FYIList also complies with intellectual property laws: we will respond to valid copyright, trademark, or other infringement notices by removing or disabling access to the reported content (see the Copyright Infringement section below for details). Users who post infringing material or otherwise violate others’ rights may be warned or removed from the platform at FYIList’s discretion.
• User Content License to FYIList: By submitting or posting any User Content on FYIList, you grant FYIList a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content on the Site and in any other media or promotional materials associated with FYIList. This license is necessary for us to operate the Service (for example, to display your reviews or to format and incorporate your product suggestions into our listings). You retain ownership of all intellectual property rights in the content you post; this license does not transfer ownership to FYIList, but it does allow us to showcase and utilize your content. You also agree that FYIList has the right to use your display name, username, or other identifying information associated with your content for the purposes of attribution or community operations.
• No Endorsement & User Responsibility: FYIList does not endorse, verify, or guarantee the accuracy of any User Content submitted by users. All opinions and information expressed by users are their own. You understand that by using the Site, you may be exposed to content that you find inaccurate, misleading, offensive, or objectionable. You agree that FYIList will not be liable for any harm or damages of any kind arising from or relating to User Content (e.g., reliance on another user’s review or a user-submitted link leading to unwanted content). Each user is solely responsible for the content they post and any consequences that result from it. If you encounter content that violates these Terms or is otherwise problematic, you can report it to us for review.

6. THIRD-PARTY CONTENT AND EXTERNAL LINKS:

• The FYIList platform may display or contain content provided by third parties, as well as links to external websites or resources. This includes, for example, product listings and descriptions sourced from external retailers, advertisements or sponsored banners, embedded videos or social media feeds, and other content not authored by FYIList. 
• When you click on a third-party link on FYIList (for instance, a “Buy” button or an advertisement), you will leave the FYIList website and be directed to an external site that is not controlled by us. Note: Once you leave our Site, these Terms and our Privacy Policy no longer apply; instead, the terms and policies of the respective third-party site will govern your use of that site. 
• FYIList does not control or guarantee the availability or accuracy of any third-party content or external sites. We are not responsible or liable for any third-party materials, products, or services, including their quality, legality, reliability, or any damages or losses they may cause. The inclusion of any third-party content or link on FYIList is not an endorsement or recommendation by us of the third-party, their content, or their services. You acknowledge and agree that FYIList shall not be held responsible for any loss or damage of any sort incurred as the result of your access to, or use of, any third-party websites, services, or content. 
• We strongly encourage you to review the applicable terms of service, privacy policies, and any other legal agreements of any third-party websites or services that you visit or use through links from FYIList. Any interactions or transactions with third-party sites are solely between you and that third party, and FYIList is not a party to or responsible for those dealings.
• Use of ThirdParty Content: FYIList may display images, logos, descriptions, product specifications, prices and other materials (“ThirdParty Content”) obtained from online retailers and other thirdparty websites, without always having secured explicit permission from the original rights holders. Such ThirdParty Content is used solely for informational and editorial purposes—to help our community discover and compare products—and is not intended as a statement that FYIList owns or endorses those materials.
• No Warranty of Rights: FYIList does not warrant or represent that it has any license, assignment, or other right to reproduce or distribute all ThirdParty Content featured on the Site. All copyrights, trademarks, and other proprietary rights remain with the respective third party owner. FYIList’s use of such content does not imply any endorsement by, or partnership with, the content owner.
• Safe Harbour under Indian Law: Under Section 79 of the Information Technology Act, 2000, FYIList qualifies as an intermediary and enjoys safe harbour immunity, provided that:

1. 1. We do not initiate the transmission or select the content;
   2. Upon obtaining actual knowledge (or on receiving notice) of infringing content, we act expeditiously to remove or disable access to it; and
   3. We have designated a Grievance Officer to receive and process infringement notices (see Contact Information).

• Infringement Notices & Removal: If you are a rights holder (or authorized agent) and believe any Third‑Party Content on FYIList infringes your intellectual property rights, please notify our Grievance Officer in writing with:

1. 1. Identification of the infringing material (URL or listing title);
   2. Evidence of your ownership (e.g. registration details);
   3. Your contact information; and
   4. A statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorized representative.

Upon receipt of a valid notice, FYIList will expeditiously remove or disable access to the allegedly infringing content and inform the party who posted it.

• Repeat Infringers: In accordance with Indian law, FYIList may terminate or suspend the accounts of users who are repeat infringers of third party intellectual property rights.

7. INTELLECTUAL PROPERTY RIGHTS:

• FYIList’s Intellectual Property: All original content and materials on the FYIList Site – including but not limited to the website design and layout, compiled listings and databases, text, graphics, logos, icons, images, software code, and overall look-and-feel – are the property of FYIList or its content licensors and are protected by applicable intellectual property laws (such as copyright and trademark laws). FYIList’s names, logos, and branding elements are trademarks or service marks of FYIList. You agree not to copy, reproduce, distribute, create derivative works from, publicly display, or otherwise exploit any protected portion of the Site without prior written permission from us or the respective rights holder. Using FYIList’s content for any commercial purpose (other than as allowed through the normal use of our Services) is strictly prohibited without authorization. 
• User Content License to FYIList: You retain ownership of the User Content you create and submit to FYIList. However, to operate the platform, FYIList requires certain usage rights to that content. Therefore, by posting or submitting User Content on our Site, you grant FYIList a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, copy, reproduce, modify, adapt, edit, translate, publicly perform, publicly display, store, distribute, and create derivative works from your User Content in connection with operating and marketing the Service. This license extends to trust affiliates or partners working on behalf of FYIList, solely for the purpose of providing or improving the Services, and it includes the right to sublicense these rights to the extent needed to outsource any service operations (for example, content delivery networks or social media channels that might display user-submitted content). You also agree that FYIList may use the name, username, or alias you provide in connection with your content. You represent and warrant that you have all necessary rights to grant this license for any content you submit. This user content license survives any termination of your use of the Service (meaning we may retain content backups or continue to display your past contributions that were publicly posted, unless you explicitly remove them and our policies permit complete deletion).

8. COPYRIGHT INFRINGEMENT:

8.1.FYIList respects the intellectual property rights of others and seeks to comply with Indian law, including the Copyright Act, 1957 and the Information Technology Act, 2000.

8.2.If you believe any content on FYIList infringes your copyright, you may send a written notice to our Designated Grievance Officer (contact details below) containing:

(a) Identification of the copyrighted work you claim has been infringed;

(b) Identification and URL of the allegedly infringing material on the Site;

(c) Your contact information (name, address, email, phone);

(d) A statement that you have a goodfaith belief the use is not authorized by the copyright owner;

(e) A statement, under penalty of perjury, that the information in your notice is accurate and you are the owner or authorized agent; and

(f) Your electronic or physical signature.

8.3.Upon receipt of a valid notice, FYIList will expeditiously remove or disable access to the infringing material and notify the user who posted it. We will also inform the complainant once action has been taken.

8.4.FYIList relies on the “safeharbour” protections of Section 79 of the IT Act. To maintain safeharbour immunity, FYIList:

1. Is a passive intermediary—not the originator or editor—of User Content.
2. Does not initiate transmission, select recipients, or modify content.
3. Upon acquiring actual knowledge (or on being notified by our Grievance Officer) that content is infringing, acts expeditiously to remove or disable access.

8.5.We may terminate accounts of users who are repeat infringers of copyright or other intellectual property rights.

8.6.Misrepresenting infringement (knowingly sending a false notice) may subject you to liability under applicable laws, including damages and costs.

      9. DATA PROTECTION AND PRIVACY:

9.1.We collect and process personal data in accordance with:

(a) The Information Technology Act, 2000 (Section 43A and SPDI Rules, 2011) on “sensitive personal data or information”;

(b) The Digital Personal Data Protection Act, 2023; and

(c) Any other applicable Indian regulations.

All privacy requests or complaints should be directed to the Grievance Officer.

9.3.Personal Data Rights:

You have the right to:

(a) Confirmation & Access: Confirm whether we hold your personal data and request a copy.

(b) Correction & Update: Rectify or update inaccurate or incomplete data.

(c) Erasure (“Right to be Forgotten”): Request deletion of personal data where we have no lawful reason to retain it.

(d) Data Portability: Request a machine‑readable copy of the data you provided.

(e) Withdraw Consent: Withdraw consent for processing based solely on consent (e.g. marketing) at any time, without affecting past processing.

(f) Objection & Restriction: Object to or request limitation of processing where you believe it is unlawful or unnecessary.

9.4.To exercise any right, please submit a request to our Grievance Officer. We will acknowledge within 7 days and respond substantively within 30 days, per DPDP Act requirements.

9.5.Purpose & Retention: We process data for the purposes described in our Privacy Policy (e.g. to provide Services, communicate with you, improve the Site, and for security). We retain personal data only as long as necessary for these purposes or to comply with legal obligations (for example, records required under tax or corporate law).

9.6.Security Practices: In compliance with our obligations under Section 43A of the IT Act and SPDI Rules, we have implemented reasonable technical and organizational measures (such as encryption, access controls, and regular audits) to protect personal data against unauthorized access, alteration, disclosure, or destruction.

9.7.Cross‑Border Transfers: When data is transferred outside India (for example, to cloud service providers), we ensure an adequate level of protection by contractual safeguards or adherence to DPDP Act transfer standards.

9.8.Children’s Data: We do not knowingly collect personal data from children under 18. If we learn that we have collected such data without parental consent, we will promptly delete it.

10. DISCLAIMERS OF WARRANTIES:

• Disclaimer: Your use of FYIList is at your sole risk. The Site and all Services are provided on an “AS IS” and “AS AVAILABLE” basis. FYIList and its affiliates, suppliers, and partners expressly disclaim all warranties and conditions of any kind, whether express, implied, or statutory, including without limitation any implied warranties of title, non-infringement, merchantability, fitness for a particular purpose, accuracy, and quiet enjoyment. We make no warranty that the Site or Services will meet your requirements or expectations, that access will be uninterrupted, timely, secure, or error-free, or that the results or information obtained from the use of the Services will be accurate or reliable. FYIList does not warrant that the content on the Site (including product listings or user reviews) is correct, complete, or up-to-date. We disclaim any responsibility for any harm to your computer system, loss of data, or other damage that may result from your access to or use of FYIList (including any downloads of content from the Site). 
• Third-Party Warranties: FYIList is not the seller of any third-party products accessed through our platform. We make no guarantees or warranties of any kind on behalf of third-party retailers or products. Any warranties (such as product quality, durability, fitness, or safety) are offered, if at all, by the third-party providers or manufacturers of those products and not by FYIList.

11. LIMITATION OF LIABILITY:

• To the fullest extent permitted by applicable law, in no event shall FYIList, its owners, directors, officers, employees, agents, partners, or affiliates be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or other intangible losses, arising out of or related to your use of (or inability to use) the Site or Services, or arising from your reliance on any content on FYIList, whether in contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.
• FYIList’s total cumulative liability to you for any direct damages or losses (whether in contract, tort, or otherwise) shall not exceed the amount (if any) that you paid to FYIList for use of the Services in the past six months, or USD $100, whichever is less. (In many cases, users pay no fees to use FYIList, as it is a free service; this clause ensures that our liability remains limited accordingly.) 
• Exceptions: Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. To the extent that such laws apply to you, some of the exclusions or limitations above may not apply. In such cases, FYIList’s liability will be limited to the maximum extent permitted by law.

12. INDEMNIFICATION:

• You agree to indemnify, defend, and hold harmless FYIList and its officers, directors, employees, and agents from and against any and all third-party claims, demands, lawsuits, proceedings, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees and court costs) that arise out of or relate to: (a) your violation of these Terms or of any law or regulation; (b) your infringement or misappropriation of any third party’s rights (including intellectual property rights or privacy rights); or (c) your use of the FYIList Site and Services or any content you post. 
• For example, if you post defamatory or copyrighted material without permission and it results in a lawsuit against FYIList, you will be responsible for all costs and damages we incur as a result of that content. This indemnification obligation will survive the termination of your Account or your cessation of use of the Services. We will reasonably notify you of any such claim or demand that is subject to your indemnification obligation once we become aware of it, and we reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with our defense of such claim at your expense).

13. MODIFICATION OF TERMS AND SERVICE:

• Changes to Terms: FYIList may modify these Terms and Conditions from time to time at our sole discretion. When we make changes, we will post the updated Terms on this page and update the “Last updated” date at the top. It is your responsibility to review the Terms periodically for any changes. If you continue to use the Site or Services after the Terms have been updated, you are agreeing to the revised Terms. If you do not agree with a change to the Terms, you must stop using FYIList. In the case of material changes, we may (but are not obliged to) provide additional notice of the update, such as via email to registered users or a notification on the Site. 
• Changes to Services: FYIList also reserves the right to modify, suspend, or discontinue any aspect of the Services at any time. This includes, for example, adding or removing features, changing the layout or content available, imposing limits on certain features, or shutting down the Service entirely. Such changes may be made without notice and without liability to you. We are not liable if for any reason all or any part of the Site is unavailable or modified at any time.

14. GOVERNING LAW AND DISPUTE RESOLUTION:

These Terms and any dispute or claim arising out of or relating to these Terms or the use of the Services (each a “Dispute”) shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. However, FYIList retains the right to seek injunctive or equitable relief in any jurisdiction to protect its intellectual property or confidential information. 

14.1.Amicable Negotiation: In the event of any Dispute between you and FYIList, the parties will first attempt to resolve the issue informally and in good faith. A party raising a Dispute must provide written notice to the other party describing the nature of the claim or issue. Within 30 days of such notice, you and FYIList agree to meet (virtually via video conference, or in person if feasible) and engage in sincere negotiations to attempt to resolve the Dispute amicably. 

14.2.Mediation: If the Dispute is not resolved through direct negotiation within 30 days of the initial notice, either party may choose to submit the matter to mediation in accordance with the Arbitration and Conciliation Act, 1996. Mediation will be facilitated by a single, neutral mediator. The mediator will be jointly selected by the parties. If the parties cannot agree on a mediator within 15 days of the decision to mediate, the mediator shall be appointed by the Indian Council of Arbitration (ICA) according to its mediation rules. The mediation sessions shall take place in Mumbai, India, and will be conducted in the English language. Each party will bear its own costs of mediation, and the parties will share the mediator’s fees and any administrative costs of mediation equally, unless otherwise agreed. 

14.3.Arbitration: If the Dispute has not been resolved by mediation within 30 days after the mediation process began (or if either party refuses to participate in mediation), then the Dispute shall be finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration will be administered by the ICA in accordance with its applicable arbitration rules. A single arbitrator will be appointed to hear the case. The seat and legal venue of the arbitration shall be Mumbai, India, and the arbitration proceedings shall be conducted in English. The arbitrator’s award shall be final and binding on both parties, and judgment on the award may be entered in any court of competent jurisdiction. The parties agree to carry out any award without delay. The costs of arbitration (including the arbitrator’s fees and ICA administrative fees) shall be borne as determined by the arbitrator, and each party shall bear its own legal fees unless the arbitrator decides otherwise. 

14.4.Interim Relief: Notwithstanding the above negotiation and mediation requirements, either party has the right to seek interim or preliminary relief (such as a temporary restraining order or injunction) at any time from a court of competent jurisdiction in order to protect its rights or assets while the mediation or arbitration is pending. Seeking any such interim relief will not be deemed a waiver of the obligation to resolve disputes through mediation/arbitration as outlined in these Terms.

14.5.Jurisdiction for Litigation: Subject to the above arbitration agreement, any court proceedings (such as motions to compel arbitration, confirm or challenge an arbitral award, or if a Dispute is for some reason deemed not subject to arbitration) shall be brought in the appropriate courts located in Mumbai, India. Both you and FYIList consent to the exclusive jurisdiction of the courts in Mumbai, Maharashtra for the resolution of any court actions relating to the Dispute or the enforcement of an arbitration award. 

14.6.You agree that you will not pursue any claim against FYIList as a class action, either in arbitration or in court, and that each party will only submit their own individual claims (not as a plaintiff or class member in any purported class or representative proceeding).
